Terms of Service

1. Agreement & acceptance

These Terms of Service form a binding contract between you and RPG Welten UG (haftungsbeschränkt), Stolzestraße 10, 44139 Dortmund, Germany ("Quizlix", "we", "us"). You accept these Terms when you create an account or use any part of the Quizlix service. We may update these Terms from time to time — significant changes (e.g. price, auto-renewal rules) will be notified by email at least 30 days in advance.

2. What Quizlix is

Quizlix is a SaaS (software-as-a-service) tool for designing, hosting and running live quiz events ("pub quiz nights"). It includes:

• A quiz builder (questions, rounds, media, branding)
• A live host view (big-screen, timer, scoring) and player join via 6-letter code or QR
• Subscription plans — Starter (free) and Host ($29/month) — and a 14-day Host trial with no credit card required
• Email-based support and account management

3. Eligibility & accounts

• You must be at least 18 years old, or the age of majority in your jurisdiction, and have authority to enter into this contract on behalf of yourself or your business.
• One account per person or per venue. No sharing of login credentials.
• You're responsible for keeping your password safe and for all activity that happens on your account.
• You must provide accurate contact information and keep it up to date.

4. Free trial, billing & payment

• Free trial: 14 days of Host-tier access, no credit card required. We'll send reminder emails on day 7 and day 13.
• After the trial: nothing happens automatically. You drop to the free Starter plan unless you actively upgrade.
• Subscription pricing: Starter is free; Host is $29 / month, billed monthly in advance.
• Payment processing: handled by Mollie B.V. (NL). Accepted methods: Visa, Mastercard, Amex, PayPal, SEPA Direct Debit, Apple Pay, Google Pay. We never see or store your card number.
• Taxes: prices shown are net of any applicable VAT or sales tax. Tax may be added at checkout based on your location and Mollie's tax determination.

5. Auto-renewal & cancellation

Host subscriptions renew automatically at the end of each monthly billing period until you cancel. To cancel, go to Account → Subscription → Cancel in your account, or email rezeption@pubquiztool.com.

• You keep Host access through the end of your current paid period — no pro-rata for early cancellation.
• After your access ends, your account stays on the free Starter plan. Your quizzes and questions are kept.
• You can re-activate anytime.

6. Refunds & failed payments

• EU consumers have a 14-day right of withdrawal under EU law (Art. 246a EGBGB). Withdrawal is exercised by emailing rezeption@pubquiztool.com. By starting to use the Host plan immediately, you agree the right of withdrawal expires once we've fully delivered the service for that period.
• No partial refunds for unused days within a paid month — but if something genuinely didn't work, email us and we'll sort it out fairly. We don't pick fights over edge cases.
• Failed payments: we'll email you to let you know and try again. After two failed retries (about 7 days apart), Host access is suspended until you update your payment method.

7. Your content & ownership

You keep all rights to the quizzes, questions, branding assets and other content you upload to Quizlix ("Your Content"). We don't claim ownership.

You grant us a limited, worldwide, royalty-free license to store, process and display Your Content as needed to operate the service for you (e.g. show your quiz on the host's screen and on players' phones, store it in our database, include it in backups). This license ends when you delete the content or your account, except where retention is required by law (e.g. invoices).

8. Acceptable use

You agree NOT to use Quizlix to:

• Upload illegal, hateful, harassing, defamatory or sexually explicit content involving minors.
• Infringe copyright, trademark or other intellectual property rights of third parties.
• Collect personal data of players in ways that violate privacy laws applicable to you (you remain the data controller for player data within events you host).
• Attack the service (DoS, brute-force, scraping, exploiting vulnerabilities).
• Resell, white-label or sub-license the service without our written agreement.
• Use the service to send unsolicited bulk messages.

We may suspend or terminate accounts that violate these rules, with notice where reasonable.

9. Privacy & data

How we process your personal data is described in our Privacy Policy. Billing records are retained for 10 years as required by §147 AO (German tax law), even after account deletion.

10. Warranties, disclaimers & liability

Quizlix is provided "as is" and "as available". We work hard to keep it up and bug-free, but we don't guarantee uninterrupted service, fitness for a particular purpose, or that the software will meet every specific need you have.

To the fullest extent permitted by law, our total liability arising from or relating to this contract is limited to the amount you have paid us for Quizlix in the 12 months preceding the event giving rise to the claim. We are not liable for indirect or consequential damages, lost profits, or lost revenue.

The above limitations do NOT apply to liability for: intent or gross negligence; injury to life, body, or health; warranties expressly given by us; or any liability that cannot be limited or excluded under mandatory German law (e.g. ProdHaftG).

11. Indemnification

You agree to defend and hold us harmless from any third-party claims, damages or costs arising from (a) your violation of these Terms, (b) Your Content, including infringement of third-party rights, or (c) your unlawful use of the service. We'll let you know promptly of any such claim.

12. Termination, governing law & jurisdiction

• You can terminate at any time by canceling your subscription and/or deleting your account from Account → Settings.
• We may terminate with 30 days' notice for any reason, or immediately if you materially breach these Terms (with notice where reasonable).
• On termination: account access ends, Your Content is deleted within 30 days (except backups, overwritten within 30 days), billing records retained 10 years.
• Governing law: German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
• Jurisdiction: for disputes with business customers, the exclusive court is Dortmund, Germany. EU consumers may also sue at their place of residence; consumers in other jurisdictions retain mandatory protections of their home jurisdiction.

The European Commission provides an Online Dispute Resolution platform: ec.europa.eu/consumers/odr. We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
